Terms of Service

1. Introduction

Welcome to Betavend ("we", "our", or "us"). Betavend is a digital platform that enables users to purchase airtime, data bundles, pay electricity bills, and subscribe to cable TV services in Nigeria. By creating an account or using any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. User Eligibility

To use Betavend, you must: (a) be at least 18 years of age or the age of majority in your jurisdiction; (b) be a resident of Nigeria; (c) provide accurate and complete registration information; and (d) not have been previously suspended or removed from the platform. By registering, you represent and warrant that you meet all eligibility requirements. You are solely responsible for all activity on your account.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials, transaction PIN, and account information. You must notify us immediately at [email protected] if you suspect any unauthorised access to your account. Betavend will not be liable for any loss or damage arising from your failure to comply with this obligation. You agree not to share your account with any third party.

4. Services Offered

Betavend currently provides the following services: (a) Airtime top-up for MTN, Airtel, Glo, and 9mobile; (b) Data bundle purchases for all major Nigerian networks; (c) Electricity bill payments for all DISCOs (Distribution Companies) including prepaid token purchases and postpaid bill payments; (d) Cable TV subscriptions for DSTV, GOtv, and StarTimes. All services are delivered instantly upon successful payment. Betavend reserves the right to add, modify, or discontinue any service at any time with or without notice.

5. Transactions & Payments

All transactions are processed in Nigerian Naira (NGN). Service prices displayed on the platform are inclusive of our processing fee. Prices are subject to change without prior notice, reflecting changes in wholesale costs from our service providers. A transaction PIN is required for all purchases as an additional security measure. Once a transaction is successfully processed and delivered, it cannot be reversed. You acknowledge that electronic payments are final upon confirmation.

6. Wallet Usage

The Betavend wallet is a stored-value account used exclusively for purchasing services on our platform. The wallet does not earn interest. Wallet funds may be used only for services available on Betavend and cannot be transferred to another user or withdrawn to a bank account. Betavend employs fraud monitoring on all wallet transactions. Suspicious activity may result in temporary hold of funds pending investigation. Minimum wallet funding amount is ₦100. Maximum wallet balance is ₦1,000,000 for unverified accounts and up to ₦5,000,000 for fully verified accounts.

7. Failed Transactions & Reversals

In the event that a transaction fails after your wallet has been debited, Betavend will automatically reverse the full deducted amount to your wallet within 10 minutes. If the automatic reversal does not occur within 30 minutes, please contact our support team. Betavend will investigate and resolve all genuine failed transaction disputes within 24–72 hours. A transaction is considered "failed" only when confirmed by both our system and the service provider. Transactions confirmed as "delivered" by the service provider will not be reversed regardless of claim.

8. Prohibited Activities

You agree not to: (a) use the platform for any unlawful purpose or in violation of any Nigerian law or regulation; (b) attempt to gain unauthorised access to any part of the platform or its systems; (c) use automated tools, bots, or scripts to access the platform without express written permission; (d) resell services obtained through the platform at prices that violate our agent agreement; (e) submit fraudulent transaction disputes; (f) impersonate any person or entity; (g) use the platform to launder money or finance terrorist activities. Violation of any prohibited activity may result in immediate account suspension and/or legal action.

9. Account Suspension & Termination

Betavend reserves the right to suspend, restrict, or terminate your account at any time for reasons including but not limited to: (a) suspected fraudulent activity; (b) violation of these Terms of Service; (c) multiple failed payment disputes found to be unfounded; (d) failure to complete KYC verification within the required timeframe; (e) court order or regulatory directive. Upon termination, any unused wallet balance that has been legitimately funded will be refunded to the original funding source within 7–14 business days, subject to verification.

10. Limitation of Liability

Betavend acts as an intermediary between you and third-party service providers (telecom networks, DISCOs, DSTV, etc.). We are not liable for: (a) delays, outages, or failures caused by third-party providers; (b) incorrect meter numbers, phone numbers, or smartcard numbers provided by you; (c) service downtime of network providers; (d) loss of data or service after successful delivery to the provider. To the maximum extent permitted by Nigerian law, Betavend's total liability for any claim arising from use of the platform shall not exceed the value of the specific transaction in dispute.

11. Changes to Terms

Betavend reserves the right to update these Terms of Service at any time. When we make material changes, we will notify you via email and/or in-app notification, and update the version number of this document. Continued use of the platform after the effective date of the updated Terms constitutes your acceptance of the new terms. You may be required to explicitly re-accept updated terms before making further purchases. Previous versions of our Terms are archived and available upon request.

12. Governing Law

These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from or in connection with these terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to arbitration in Lagos, Nigeria under the Arbitration and Conciliation Act. Nothing in this clause shall prevent Betavend from seeking injunctive relief in any court of competent jurisdiction.
